The general terms and conditions of the online advertisement or portal Živalnik.si comply with the Consumer protection act (ZVPot-1), the Personal data protection act (ZVOP-2) and the Electronic communications act (ZEKom-2). The general conditions are updated in accordance with changes in the relevant regulations. The changes enter into force the day after their publication on the Živalnik.si website.

The specialized web portal or advertisement Živalnik.si (hereinafter referred to as »Živalnik«) is managed by the company BNG d.o.o., which is also a provider of e-business services (hereinafter referred to as the »Controller«).


1.2 Acceptance of the general terms of business on the Živalnik website

By using the Živalnik website, the visitor and/or user accepts these general terms and conditions and confirms that they are familiar with them and consents to their content.


1.3 General information about the Živalnik website

Access to the website www.zivalnik.si is also possible via the Živalnik.si domain. The general business conditions apply and are defined for both websites: www.zivalnik.si / www.živalnik.si.


The website Živalnik.si is a specialized Slovenian online advertisement or portal, dedicated exclusively to the field of small animals as pets. It allows users to quickly and easily post and view ads for sale, purchase or rent-adopt of all types of pets, equipment, pet food and services.

Users who are registered legal entities, independent entrepreneurs or providers on the Živalnik.si website are also allowed to submit the aforementioned ad in the sense of »animal services«, where they can present their range of activities to potential buyers.


What does the Živalnik represent and for what purpose does it work?

Živalnik acts as an intermediary between buyer and seller and represents the first specialized online classifieds for small animals in Slovenia, which brings together classified ads of breeders, online providers of equipment, food and services in one place.

Živalnik therefore brings together buyers and sellers through classified ads, and also offers an overview of online providers registered in Slovenia for this activity, who do business in the world of pets (equipment, food and various services for animals).

Živalnik is an online marketplace that connects the entire world of animals and people. For all owners, caretakers and animal lovers, we present a website where love for animals comes first and where everything you need can be found in one place. From information, breeders, current advertisements of puppies, all the way to a rich offer for animals, which is published by the leading Slovenian providers in this segment.


1.4 The owner and operator of the website Živalnik

(hereinafter: Operator)


The general conditions of use of the Živalnik website determine the rights and obligations of BNG d.o.o. as the owner and operator of the website, the rights and obligations of users and the methods and conditions of use of the website. The general business conditions represent a legally binding agreement between the user and the operator for the use of the Živalnik website and related services.

By entering the website, the user confirms that he is familiar with these general conditions of use, that he/she agrees with them and that he/she is bound by their provisions. The administrator therefore recommends that users familiarize themselves with the general conditions of use immediately after entering the website. Acceptance of these terms of business is also a condition for registration on Živalnik.si.

3. Registration, user types and profile deletion

Users of the Živalnik website can be unregistered or registered. Unregistered users can use free services (e.g. viewing ads, using the Živalnik Forum, viewing product information, etc.). By registering, registered users gain access to some additional functionalities of the Živalnik website, which are not available to unregistered users.

Registered users have their email address and password linked to the type of user for which they registered. The electronic address and password must be kept as a business secret and must not be entrusted to another person. Registered users assume responsibility for all activities that will be carried out with their user email address and password.

Any use of the Živalnik website, that does not represent the normal or expected use of an individual is prohibited, may constitute economic damage and will be reported to the appropriate law enforcement agencies. Normal use is use without any software tools (spiders, scripts,...) and in the sense of a normal number of requests for insight in a certain time, whereby we consider a normal number of max. 2 requests per second.

Therefore, the Živalnik website can be accessed by all users, regardless of whether the individual user is registered or logged into their user account / profile, or is identified as an unregistered user.

3.2 User registration on the Živalnik website

To submit an ad, you need to log in to your user profile, which requires prior registration. Users can register as a »general user« or as a »legal entity«, as stated above in point 2.1.

For this purpose, on the Živalnik website, a person selects the appropriate type of user, as part of the registration form. Registration is not permitted for individuals under the age of 15.

The registration form must be filled out correctly and completely. Fields marked with an asterisk are required. Entering the data of third parties without their express permission is prohibited. Before confirming the registration, each user must confirm that they agree to the terms and conditions stated in the registration form itself. All entered data, except for the username, can be changed at any time after registration and profile activation. The user can change the public visibility of his/her personal data from the user profile at any time.

As part of the registration process, by clicking on the "Create user profile" button, the user declares that he is at least 15 years old and that all the entered data is accurate and true. For all additional information and clarifications regarding registration, users are always available for help via e-mail: info@zivalnik.si.


3.3 Deleting a profile on the Živalnik website

Deleting a user's profile means deleting the subject profile and all advertisements and other content related to this profile. Also, deleting a profile means stopping receiving all notifications intended for users. If the user wants to delete his/her profile, he/she can do so by logging into his/her Živalnik user profile at www.zivalnik.si and within the control panel by selecting the option »Delete profile (Cancel registration)« and do so manually.

After the final confirmation of the deletion of the profile, the manager will delete the user's personal data no later than within 30 days after the final confirmation of the deletion of the profile by the user.

4. Use of the website and advertising

 

4.1 Use and advertising on the Živalnik website

Registration and related use of the Živalnik website is completely free for both, general users and legal entities.


Certain functionalities are only accessible by using the upgraded package of the user's profile or by individually leasing the desired additional exposures or Živalnikov advertising products, which are available through the advertising offer on the separate »Živalnikov shop« subpage.

Due to the nature of the activity they perform, registration for shelters / associations is free, as well as all other functionalities available on the Živalnik website. Therefore, this type of user does not have any restrictions regarding the use of the functionalities offered on the Živalnik website.

After registration, Shelters and Societies (General User - Shelters and Societies) can use all the functionalities of the Živalnik website and publish their own classified ads.


4.2 Special status for breeders: Status of verified breeder

General users (breeders) can take advantage of the status of »verified breeder« on the Živalnik.si Pets Marketplace platform and thus enjoy free advertisements for pedigree litters or puppies, exposure on a special page for breeders and more.


How to become a verified breeder?

Within your profile in the »Breeder« category - upload a valid certificate for your kennel or cattery (breeding card) and thus activate the special »Verified breeder« badge, which will appear next to all your classified ads.


How to post classified ads for free?

First, obtain the status of verified breeder described above, and then at the level of submitting your ad, add the required documents and publish your classified ads for pedigree puppies for free.

Below we present the key innovations and improvements for breeders that we introduced with our comprehensive overhaul of the Živalnik.si Pets Marketplace platform:


1. A page for breeders and pet seekers:

We have set up a special page to showcase verified breeders and their offers for pet seekers.


Exposure on the »Breeders« subpage: Gain additional visibility and long-term exposure on the most visited and adapted page for »Breeders« in Slovenia and the entire Adriatic region. Present your profile with confirmed »Verified Breeder« status and your current classified ads. On this page, you will be maximally accessible for all searchers who are consciously looking for a specific breed of puppy from proven pedigree breeding.

*Note: In order to be present on this subpage, prior registration is required (user type: Breeder) and the upgrade of the free profile package to the paid version.


2. Publication of classified ads & pricing policy:

Živalnik supports pedigree breeding, so we are introducing free classified ads for pedigree litters or puppies from verified breeders.

Get the status of a verified breeder, upload the required documents and publish your classified ads for pedigree puppies free of charge (Certificate of kennel/cattery - Breeding card, Pedigree of male - Father, Pedigree of female - Mother).


3. »Verified Breeder« badge:

Gain trust with a verified breeder status and attract more attention. The possibility of supplementing your profile with the attached document of a valid kennel or cattery certificate and activation of the special »Verified breeder« badge, which will appear next to all your classified ads.

 

4.3 Payable categories when publishing an ad

When using the Živalnik website and the related use of the »ad submission form« functionality: The publication of all animal advertisements relating to the category »Without pedigree« are of a paid nature, in accordance with the advertising price list published each time for this part, which also contains entry into force information.


Živalnik has developed a special system for verifying the content of the ad in such a way, as to enable the user to enter certain fields through which he/she can confirm, that the published ad (Animals) is for pedigree representatives of a certain breed. In the case of this type of advertisement, when it is a pedigree animal, this publication is free of charge.

Živalnik supports pedigree breeding of animals, so the publication of such ads by verified breeders is absolutely free. The publication of an ad for non-pedigree representatives of animals is chargeable.

By confirming the publication of a classified ad, after completing the technical steps leading to the publication of a classified ad, the contract between the administrator and the user is concluded. With this, the distance contract is considered to be concluded, and the service (publishing of a classified ad for a mutually agreed time and under mutually agreed conditions) is completed after payment has been received. As far as relations with consumer users are concerned, the operator acts in accordance with the currently applicable consumer protection act (ZVPot), when managing the website. The operator guarantees users who are consumers according to the ZVPot all rights arising from the ZVPot.


Živalnik.si Pets Marketplace (BNG d.o.o.) reserves the right to change the price list without prior notice.


4.4 Živalnik shop and various advertising products on the Živalnik website

»Živalnik shop« is a separate subpage, intended for all users of the Živalnik website and enables the presentation and purchase of the desired advertising product, that is available at a given moment. In order to purchase the selected advertising product, the user must be logged in to his/her user account of the previously created registered profile.

Therefore, as part of the completed registration, regardless of the selected type of user, he/she is automatically assigned a free package that ensures uninterrupted use of the Živalnik website in accordance with a certain set of functionalities, that are available or reachable as part of the free package. (except for »Shelters and Associations«)

In any case, every user has the option, as part of the registration process (form), to change their free package to a paid one, or upgrade it, or to do it later, within their control panel, which is visible after logging in to their user account.

Every user can access certain functionalities, regardless of whether they have selected a free or upgraded (paid) package, as part of their user account. He/she can also do this by accessing the Živalnik Shop, which presents a separate subpage for all users with the purpose of additional advertising and exposure. Here you can lease the desired Živalnik product or advertising service and thus access the desired functionality.


Therefore, any user on the Živalnik website can access additional functionalities in two ways, for a fee:

Any use of additional advertising or exposure related to Živalnik's product, which is presented and available within the »Živalnikov shop« subpage, is also visible to the user within his/her user account in the control panel (Order History), where he/she can monitor all his past purchases / order history and other data related to this purchase or advertising activities (Date of purchase, status, price, etc.).

As part of this separate »Živalnik shop« subpage, Živalnik's products for additional advertising or various exposures are available to all registered users at prices, that are consistent with the valid price list published on the Živalnik.si website. The final price for an individual payment is always visible before the final confirmation of the purchase of the ordered services. The registered user receives the invoice for the service rendered to his/her e-mail address, with which he/she fully agrees. 

As a rule, the operator does not return the paid amount. Any user can address a request for a refund of the paid amount to info@zivalnik.si editorial office, which assesses the merits of the received request and informs the user of its decision within 30 days of receiving the request. For the cases listed below, it is not possible to claim a refund of the funds paid:


The operator reserves the right not to refund the paid amounts also in other implicitly stated cases.

Funds paid can be used exclusively for advertising services and products on the Živalnik.si website and its related profiles from third-party providers.

Possible payment methods are with credit or debit cards or via a universal payment order (payment by advance invoice).


4.5 Payment methods and conditions for publishing an ad

On the Živalnik.si Pets Marketplace platform, we value diversity and advocate for a diverse range of classified ads.


A) Publication of Classified Ads: Prices for the publication of classified ads depend on the category and the leased period. The exact price for the category the user's ad is in, will be displayed during the ad posting process.


B) Additional advertising and exposures of classified ads (Živalnik Shop): Prices related to additional advertising and exposures of classified ads also depend on the Živalnik product, that the user will lease and on the selected time period.


C) Payment methods: The payment methods listed below refer to the Živalnik.si Pets Marketplace platform and apply only to Živalnik's advertising products, which can be rented as part of the Živalnik Shop page.


D) Payment transactions: The Živalnik.si Pets Marketplace platform uses stripe technology for payment transactions.

The advertising service selected by the subscriber (user), will be activated immediately after successful receipt of payment.

Note: For services that require additional information, the subscriber will be contacted by the editorial board, after receiving the user's order. Order status can be tracked in the user profile under »Order History«.



General or legal user payment

The payment of a general or legal user in accordance with the price list and general conditions is carried out:

In accordance with the applicable rules and regulations, all purchases of Živalnik products or services made through the Živalnik.si Pets Marketplace website or the Živalnik Shop subpage are subject to value added tax (VAT).



4.6 Payment terms, activation, and cancellation of ordered advertising services

Upon successful payment for the selected advertising service, the user receives an electronic invoice. The invoice is automatically sent to the email address provided during the order and is always accessible in the user control panel under the "Order History" category. All paid advertising services with a fixed duration (e.g., ad placements for 1, 7, 14, 30 days, or more) will be activated immediately upon successful payment. The customer agrees that in the event of early termination of the service, they cannot request a refund or proportional reimbursement for the unused period. 

The 14-day right of withdrawal applies only to services that have not yet been executed. If the service has already been fully or partially provided, a refund is not possible. Likewise, the customer cannot exercise the right of withdrawal for services that were expressly executed immediately after payment at their request.

5. Protection of personal data

 

5.1 Data protection on the Živalnik website

Registered users of the Živalnik website expressly authorize the operator to collect and process the following data, which is necessary for this purpose, in order to ensure the operation of the website and the services offered:

The operator undertakes not to pass on the above-mentioned data to unauthorized persons and to protect the personal data of users in accordance with the provisions of the personal data protection act (ZVOP-2), the consumer protection act (ZVPot) and the electronic communications act (ZEKom- 2).

The users themselves are also responsible for the protection of personal data, namely by ensuring the security of their e-mail address and password, as well as the appropriate software (antivirus) protection of their computer or mobile device, which enables the use of Živalnik.

Users have the right to view, copy, amend, correct, block and delete personal data relating to them.


Users agree that, for the purposes of resolving potential disputes or complaints, when submitting advertisements, the date and time of advertisement submission and information about the user's IP address are recorded, and that in case of suspicion of a criminal act or illegal use, the said data will be forwarded to the competent authorities.

The operator is not responsible for the processing of personal data that users exchange with each other, when using the Živalnik Chat (message) function, as well as on the Živalnik Forum.

The Živalnik website uses cookies. Cookies are small files, that we download to your browser on your first visit, so that we can recognize you the next time you return to our website and provide you with a better user experience.

6. Content of classified ads and accuracy of data


6.1 Content, accuracy of data and time validity of classified ads on the Živalnik.si website

For the purposes of these general terms and conditions of business, all content published on the Živalnik website by an individual user, regardless of the selected »type of user«, and containing in particular the text of the advertisement and attached image or video material, is considered as advertisement content.

The operator does not assume responsibility for the credibility, accuracy and up-to-dateness of personal data and other content published by individual users, but the user is responsible for them. The user is obliged to ensure the accuracy and up-to-dateness of all published / transmitted data.


6.2 Content of classified ads on the Živalnik website

Users must comply with the following rules when entering advertisements:


In the case of a user, who is not from the Republic of Slovenia, the content of the advertisement can also be published in the native language of the country from which he/she comes. The entire content of the Živalnik website, to which the operator has access and the possibility of editing, will also be available to all users in the following language versions: Slovenian, Croatian and English. 

Control over the selected language, on the basis of which the content of the Živalnik website will be displayed, will be available to each user via the dedicated button for switching between the specified languages.

 


The operator reserves the right to delete or not publish all or any part of the advertisement if it considers, that the publication could harm the Živalnik website or if the advertisement or part of the advertisement constitutes a violation of these terms of business, moral principles or legal provisions stipulated by the protection act animals (ZZZiv), regulations on the protection of pets, the convention on international trade in endangered species of wild fauna and flora (CITES) and other legislation in the field of nature and animal protection.

When transporting animals, users are obliged to observe the age and other restrictions set by the animal protection act (ZZZiv), the regulations on the protection of pets and other applicable legislation in this area. When dealing with wild animal species, users are limited by the provisions of the nature conservation act (ZON), by-laws, the convention on international trade in endangered species of wild fauna and flora (CITES) and other international regulations governing the subject area. Users who publish a classified ad are aware and agree that the content of their classified ads posted on Živalnik.si will be visible to all visitors to the Živalnik website, regardless of how they access it.

The Živalnik website, its operator and owners are not responsible for the veracity of submitted classified ads and their content. The classified ad, including photos, videos, links, text and other materials, that are an integral part of the classified ad, is the sole responsibility of the person submitting the classified ad.


6.3 Time validity of classified ads on the Živalnik website

All classified ads for general users (user type) in the free version published on the Živalnik.si website, are valid for 30 days from the date of publication. After the expiration of the 30-day validity period, the published advertisement is automatically withdrawn and is no longer visible on the website. The user can extend the validity of an inactive ad at any time, or public visibility through their user profile.

Every general user (type of user) in the paid version also has the option, in the process of submitting an ad, to choose or define the time value of the duration of the published ad, which is offered on the Živalnik platform at a given moment.

All small ads of legal entities or online merchants, do not have a time component, i.e., they are visible on the Živalnik website for as long as the relevant legal entity (user type, Online merchant) does not change it in its control panel (»My ads«), which is available as part of the user profile to all registered users.


6.4 Special part of the conditions for the content of online merchants (Legal entities) on the Živalnik website

In addition to what is stated in these conditions, we add the additional conditions written below, which exclusively refer to the content of users of the »Legal entity« type, or online merchants, and to their content of classified ads, rights and obligations.

6.4.1 Liability in connection with the content of online merchants (Legal entities) on the Živalnik website

The content of the web portal or the Živalnik website, does not represent official information, unless this is specifically stated. Data, information and online applications that are available on or through the web portal www.zivalnik.si can be changed at any time without prior notice.

Users use the web portal at their own risk. Neither Živalnik, nor other legal entities participating in the creation or maintenance of the web portal are liable for any damage, indirect or direct, arising from access, use or inability to use data, information and applications on the web portal or the Živalnik website.

Živalnik does not guarantee the correctness of the data that Živalnik obtains or displays from other entities. The responsibility of Živalnik for damage caused to users from this title is therefore completely excluded.


6.4.2 Use of data and information from the content segment of online merchants (Legal entities) on the Živalnik website

No data or information from the Živalnik website may be used for commercial purposes without Živalnik's permission. It is not permitted to collect data and information from the Živalnik website in any public or private database. Publications on other sites, in any form, are not permitted, if this is not explicitly stated for individual data and information.

Data and information from the Živalnik website can be transferred by the user to their systems for their own use, without changing the copyright and other related rights. Živalnik also contains an online marketplace (eCommerce), which enables transactions to be concluded via the online platform using the »Purchase from the provider« function. The information and grounds for using the website using the »Purchase from the provider« function are governed by the Terms for users »Ordering goods / products or services on the website Živalnik«.


Compliance of the published offer with ZVPot:

The entire offer published on the Živalnik online marketplace by legal entities, must comply with the consumer protection act (ZVPot). This part is entirely the responsibility of the online retailer who, as a registered user, advertises through the Živalnik platform.

The up-to-date and appropriate record of the pricing policy of the products is entirely the responsibility and task of the online seller who advertises his/her offer through Živalnik.si. This must also comply with the consumer protection act (ZVPot).

In the process of submitting the ad, a field for entering the lowest price in the last 30 days, marked PC30 on the Živalnik platform, will be additionally enabled and accessible. The seller is solely responsible for filling this field with the correct information.

PC30* = The lowest price of the product in the last 30 days before the reduction (previous price according to ZVpot-1).


Accessibility of the web portal

Živalnik strives to provide users with uninterrupted use of the Živalnik website - under normal conditions 24 hours a day. For technical reasons (maintenance and/or equipment replacement), Živalnik reserves the right to short-term interruptions of the Živalnik website or access disruptions, usually after 8 p.m.

Any disputes arising from the use of the Živalnik website contrary to the provisions of the general terms of business of the Živalnik website, will be resolved by the users and Živalnik.si in a peaceful way. If this is not possible, the court in Ljubljana will be responsible for resolving disputes.

With every classified ad, there is also a button »Report a disputed ad« available, through which your information or notification will be addressed directly to the editorial office of Živalnik, at the above-mentioned email address.


The operator undertakes to check reported inadmissible content, take appropriate action and, if necessary, remove objectionable content. The operator has the right to irrevocably block or temporarily restrict the use of the website, by a user whom it considers to have violated the relevant general terms and conditions of business, to make objectionable content available.

Users who detect possible abuse, suspicion of torture or inhumane treatment of animals can submit a report of such suspicion directly to the administration of the Republic of Slovenia for safe food, veterinary medicine and plant protection for the protection of animals. The application can also be submitted anonymously via the Žižga portal of the mentioned state body. Živalnik.si encourages the reporting of illegal treatment of animals to state authorities.


8. Limitation of liability

 

8.1 General limitation of liability on the Živalnik website

The operator of the Živalnik website will endeavor to ensure, that the content of the website is of high quality, permanently accessible, legal and up-to-date, and that it does not contain illegal, morally objectionable elements or viruses and similar factors that could damage the network infrastructure.

Despite the above, the operator is not responsible for any indirect or direct damage, including possible lost profits, which would occur due to the interruption of access, non-publishing or deletion of a small advertisement or errors in the operation of the website, as well as does not guarantee the success of the use of the website or its flawless operation.

By submitting an offer on an individual classified ad and accepting the offer by the seller who published the classified ad, an obligation relationship is established between the seller and the buyer. All possible disputes arising from this relationship (such as due to the veracity of data about the user, the content of the offer, the object and price of the offer, etc.) are resolved exclusively between the seller and the buyer. The operator of the website assumes no responsibility in cases where any of the users provide incomplete or untrue identification data. By accepting the general terms of business, by deciding to do business online, sellers and buyers assume the risks associated with the credibility of the identity of the individual user of Živalnik and responsibility for the consequences arising from doing business online. The operator bears no responsibility in the event of a dispute between users.


In relation to ensuring the operation of the Živalnik website, the operator assumes no responsibility:

8.2 Limitation of liability on the Živalnik website from classified ads

The website Živalnik acts only as an intermediary between sellers and buyers or other users and does not act in the name or on behalf of any of the users of the website.

The operator of the website has no influence on the content of published classified ads, as it is content, that users enter on the website independently and by submitting the ad, they assume full responsibility for its content and attached image or video material. As a result, the operator does not assume any responsibility for the veracity of published data, entered by natural persons or business / legal entities.

Any agreement between users concluded on the basis of classified ads published on the Živalnik website, is exclusively an agreement between users and does not represent any indirect or direct contractual relationship between the users and the operator of the Živalnik website. All possible disputes arising from the relationship between users are resolved exclusively between the users themselves, and the operator bears no responsibility in the event of a dispute between them. Each user of the website accepts these rules and expressly waives the right to recover any compensation from the operator of the website Živalnik for damage arising from the above-mentioned relationships between users.


9. Special category: Živalnik forum


In addition to what is stated in these conditions, we are adding the additional conditions written below, which refer exclusively to the content of users who have the functionality of using the Živalnik Forum and their related rights and obligations.

Use of the Živalnik forum

Upon registration, the registered user undertakes to agree to the provisions stated on this page and in the general terms and conditions. The user himself is responsible for the content he/she writes and assumes full liability for compensation, and is aware of the possibility of passive legitimation in the event of a dispute or requests from the competent authorities.

The user is obliged to protect the username with an adequately secure password (at least a six-digit password with a combination of uppercase and lowercase letters and numbers) and to protect it from other people. The operator may, at its own discretion, refuse to assign a username to an individual who refers to another person, abuses trademark law, is obscene, unacceptable, violates other rules, or maliciously imitates established nicknames of other user images.

The Živalnik editorial office recommends, that you register the nickname (author) that you use regularly to prevent confusion and other inconveniences. The editors ask, that you use the search engine before opening a new topic and that you stick to the topic when writing comments on posted messages.

Overt and covert advertising (communication in the forum with the official company name or brand name, advertisement of slogans, publication of links to other websites, all covert forms of advertising, such as guerilla marketing, sales and commercial research in forums) company BNG d.o.o. charges according to the valid price list. The company BNG d.o.o. has the right to issue an invoice to the company that advertises covertly, and the company is obliged to pay for the service billed for each identified covert advertising as described in the previous sentence.
